What Happens Without a Valid Will in New York

Dying without a will means dying intestate. Under New York intestacy law, the Surrogate’s Court distributes your estate according to a fixed statutory formula, not your actual wishes. A surviving spouse, children, and other relatives inherit in a predetermined order, regardless of your relationships or intentions. Close friends, unmarried partners, and charities receive nothing.

A properly drafted will lets you do far more than name who gets what. You can designate an executor to manage your estate through probate, appoint a testamentary guardian for minor children, create specific bequests of property or money, and set up testamentary trusts for beneficiaries who need oversight. These are decisions only you can make, and a will is the legal instrument that makes them enforceable.

After you pass, your will must be filed with Bronx County Surrogate’s Court to begin probate proceedings. Estates valued above $50,000 go through full probate. A will drafted under proper attorney supervision carries a presumption of due execution under New York law, which can reduce the likelihood of a successful contest. A DIY will that doesn’t meet the formal requirements of New York EPTL §3-2.1, signed at the end by the testator, declared to two attesting witnesses, and signed by those witnesses within 30 days of each other, can be rejected entirely, leaving the estate to pass as though no will existed.
