Types of Trusts & What Each One Does

The right trust depends on your goals: probate avoidance, incapacity planning, protecting a beneficiary with special needs, or preserving Medicaid eligibility. The options below cover the arrangements most commonly relevant to Bronx residents.

Revocable Living Trust

Created during your lifetime, a revocable living trust can be amended or revoked at any time. Assets held in the trust avoid probate and remain under continuous management if you become incapacitated. It’s one of the most flexible tools in estate planning and works alongside a will to provide comprehensive coverage.

Irrevocable Trust

An irrevocable trust generally can’t be changed once established. Assets transferred into it are removed from your taxable estate and may be protected from creditors. The tradeoff for that protection is the loss of direct control over those assets.

Special Needs Trust

In New York, this is formally called a supplemental needs trust. It provides financial support for a beneficiary with a disability without disqualifying them from Medicaid or SSI. Inheriting assets outright can cause a disabled beneficiary to lose those public benefits; a properly drafted supplemental needs trust can help avoid that issue.

Medicaid Asset Protection Trust

This irrevocable trust protects assets while preserving Medicaid eligibility for long-term care costs. New York imposes a 60-month look-back period, so this planning must happen well in advance of a long-term care need. Waiting too long can limit your options significantly.

Testamentary Trust

Created through a will and activated at death, a testamentary trust is useful for managing inheritances for minor children or beneficiaries who need oversight. Because it’s established through a will, it doesn’t avoid Bronx County Surrogate’s Court proceedings the way a funded living trust does.

How the Trust Creation Process Works

Drafting a trust is only part of the process. Funding it is equally important. An unfunded trust doesn’t avoid probate because the assets were never transferred into it. We walk clients through both steps.

The trustee you name is then legally obligated to manage assets prudently, follow the trust’s terms, file required tax returns, and keep beneficiaries informed. Errors in drafting or execution can produce unintended consequences under New York law, which is why preparation and review matter at every stage.

Do I Need a Trust If I Already Have a Will?

Can a Trust Help If I Have Children from a Prior Relationship?
