How New York Custody Law Applies to Fathers

New York courts make all custody and visitation decisions based on the best interests of the child, a legal standard that evaluates each parent’s relationship with the child, ability to provide a stable home, and history as a caregiver. Gender is not a factor. The tender years doctrine, which once favored mothers of young children, is no longer applied in New York. Fathers can and do obtain primary physical custody, shared joint custody, and substantial parenting time when the facts support it.

Most cases involve two distinct types of custody. Legal custody governs decision-making authority over the child’s health care, education, and general welfare. Physical custody determines where the child primarily lives. Parents can share legal custody while one holds primary physical custody, or a court may award joint custody of both types when both parents agree and the circumstances support it.

Establishing Paternity in New York

Before an unmarried father can seek custody, visitation, or any legal role in his child’s life, he must establish legal paternity. Fathers who were married to the mother at the time of the child’s birth are presumed to be the legal parent under New York law. For unmarried fathers, two pathways exist.

Acknowledgement of Paternity
Both parents can sign this voluntary document at the hospital at birth or afterward at a local registrar. Once signed, it establishes legal parentage without a court proceeding.

Court-Ordered DNA Testing
If paternity is disputed, a father can petition Bronx Family Court for an order requiring a DNA test. Once the result confirms parentage, the court enters a formal order of filiation, and the father can pursue custody and visitation.

How Child Support Works for Fathers in New York

New York calculates child support using an income shares formula based on both parents’ incomes and the number of children involved. Support generally continues until the child turns 21, unless specific exceptions apply, and it isn’t automatically tied to gender. When the father is the primary custodian, the mother may be ordered to pay child support to the father.

A support order doesn’t have to remain fixed. If your income has changed substantially, your parenting time has shifted, or the child’s needs have evolved, you may have grounds to petition for a modification. The court considers whether the change in circumstances is significant enough to warrant adjusting the existing order.

Modifying or Enforcing Custody and Visitation Orders

Family circumstances change. A father who was awarded limited parenting time when a child was young may have grounds to seek more as his circumstances improve or the child’s needs shift. To modify an existing order in the Bronx, a father must show a substantial change in circumstances since the original order was entered. The court then applies the best interests standard again to determine whether a change may serve the child’s interests.

Enforcement is a separate but related issue. When a parent withholds a child in violation of a custody or visitation order, Bronx Family Court can address it through a violation petition. Courts take interference with court-ordered parenting time seriously, and consistent violations may affect the offending parent’s custody rights going forward.
